Thank you Dawn for your feedback Dawn. I have updated my post to reflect the difference between EIN filing and State LLC filing.

My complaint is clear in my post. Specifically. SimpleFilings charges $128 for the free service of filing for an EIN.

"Our minimum price for obtaining an EIN on our customer’s behalf is $128.00"

If you use simplefilings.com to register your EIN for $128 when you could do it for free you are foolish.

I find the ignorance of this post astounding. In the first place an LLC is a state filing, not a federal filing. It appears as to what you were trying to do was file for an EIN for your LLC. Which is a federal filing. Note a couple of things, an LLC must be formed at the state level and assigned an EIN at the federal level. It is the exact ignorance of people who are posting on this blog that provides a need for companies such as Simplefilings, or Legal Zoom to handle these services for the inexperienced person trying to start a business. Additionally, the irs provides the avenue for third party services to handle these services for any given client so that that client doesnt have to not to mention the clients like yourself who believed you can form an LLC with the IRS.

In after thought I do business with both of the companies on a regular basis, and they both save me significant time and money taking care of all of my federal, state, and county filings for the numbers businesses that I, along with other partners, own. Could I do the process my self? Yes I probably could, did I read the fine print yes I did.

It sounds to me like a) you clearly didnt know what you were doing b) you clearly didnt read the terms and conditions which apparently they provided to you so you understood c) as you requested you were provided a 50% refund for a service that was completed as you requested. And finally, what part of this didn't stop you before you moved on to the next part of the application: REQUIRED: By clicking this checkbox, I agree to submit my information to this website. I agree that filling out these fields acts as a signature agreeing to the Terms of Use linked from this page. I hereby authorize Hermeris Inc. as a third party designee to submit my SS-4 form to the IRS, receive my EIN, and answer questions on my behalf.

It seems to me that yes you feel you were "taken" because you could have filed for an EIN for free, by the way you should know that filing LLC documents is not free in ANY state. However it also seems to me that the business you dealt with also gave you a fair return on your money considering that they made every effort to tell you they weren't the IRS, and you chose to move forward anyway, and then complain that they completed the process as you requested.

So my question to you is what exactly are you complaining about again?

If you did not give them your credit card I would assume nothing would be done. You should be fine.

I don’t know if anyone checks this anymore, but I found your experience after I have already submitted my first page of information on their website. The first page is the same as the IRS, social security number and such, you check the terms and agreements box and submit, and then the second page asks if you want to add the $50 on and such then it asks for credit card information. I saw that and thought it was a scam and closed the browser. I sent them an e-mail within the hour (which is after business hours) canceling any filing of my forms with the IRS. Can they still charge me even without me putting my credit card information in? Please help! I can’t sleep.

Thanks Zane,
Saved me a bunch of time. I too am impressed with your due diligence.

I am curious to know if Google followed up? I would be very disappointed with them if the simply ignored your request.
